Title:Preplet delovnega z migracijskim pravom in pravom socialne varnosti : primer zaposlovanja delavcev iz BiH

Abstract:Prispevek obravnava zaposlovanje delavcev iz Bosne in Hercegovine (BiH) v Sloveniji, pri čemer preuči tako migracijske kot tudi delovnopravne in socialnopravne vidike. Pri tem poleg nacionalnega prava upošteva tudi pravo Evropske unije in relevantne bilateralne pogodbe. Po pregledu pravnih podlag za zaposlitev in bivanje državljanov BiH v Sloveniji, se prispevek osredotoči predvsem na Bilateralni sporazum o zaposlovanju in izpostavi problematičnost povezave dovoljenja za delo in bivanje z delovnim razmerjem z vidika položaja delavcev migrantov. V poglavju o socialnopravnih pravicah prispevek obravnava dostop delavcev do socialne varnosti ter vlogo Bilateralnega sporazuma o socialnem zavarovanju pri zagotavljanju enake obravnave.

Title:Interconnections of labour law, migration law, and social security law: the case of employing workers from Bosnia and Herzegovina
Abstract:The paper examines the employment of workers from Bosnia and Herzegovina (BiH) in Slovenia, analysing both migration-related as well as labour law and social security aspects. In addition to national legislation, it considers European Union law and relevant bilateral agreements. Following an overview of the legal bases for the employment and residence of BiH nationals in Slovenia, the paper focuses primarily on the Bilateral Agreement on Employment. It highlights the problematic nature of linking work and residence permits to an employment relationship, particularly from the perspective of migrant workers’ status. In the section on social security rights, the paper addresses workers’ access to social security and the role of the Bilateral Agreement on Social Insurance in ensuring equal treatment.
