Title:Znanje slovenščine in dostop do zaposlitve : med jezikovno politiko države in pravicami tujih delavcev

Abstract:Prispevek obravnava vprašanje rabe slovenščine in jezikovnih zahtev pri dostopu do zaposlitve ter opravljanju dela v slovenskem pravnem prostoru. Izhaja iz dejstva, da povečana mednarodna mobilnost delavcev in rast priseljevanja v Slovenijo prinašata večjo jezikovno raznolikost na delovnih mestih, kar odpira vprašanja o razmerju med varovanjem slovenščine kot uradnega jezika in pravicami tujih delavcev do enakega dostopa do trga dela. Prispevek analizira ustavnopravni okvir rabe jezika, pravni okvir Evropske unije glede prostega pretoka delavcev ter slovensko zakonodajo, ki ureja rabo slovenščine in zahteve po znanju jezika v delovnih razmerjih.

Title:The knowledge of Slovenian language and access to employment : between the state language policy and the rights of foreign workers
Abstract:The article addresses the issue of the use of Slovenian and language requirements in accessing employment and performing work in the Slovenian legal environment. It is based on the fact that increased international mobility of workers and the growth of immigration to Slovenia are bringing greater linguistic diversity in the workplace, which raises questions about the relationship between the protection of Slovenian as an official language and the rights of foreign workers to equal access to the labour market. The paper analyses the constitutional framework for language use, the European Union legal framework on the free movement of workers, and Slovenian legislation governing the use of Slovenian and language proficiency requirements in employment relationships.
