Abstract:Prispevek obravnava vprašanje, ali se lahko delavec enostransko ali v sporazumu z delodajalcem odpove kogentnim pravicam iz delovnega prava. Tovrstni sporazumi o odpovedi v praksi niso redki, sodna praksa pa je do odločitve Ustavnega sodišča v zadevi Up-150/22 v letu 2024 dopuščala odpovedi zapadlim denarnim terjatvam iz delovnega razmerja. Ustavno sodišče je to spoznalo za protiustavno ter nezdružljivo s prisilno naravo pravic delovnega prava in varstveno naravo področja delovnega prava.

Title:Nonwaivability of labour rights
Abstract:This article addresses the question of whether an employee can waive his or her rights under labour law unilaterally or in agreement with the employer. Such individual waivers are not rare in practice, and case law until the Constitutional Court's decision in Up-150/22 in 2024 allowed for the waiver of overdue monetary claims. The Constitutional Court found this case law unconstitutional and incompatible with the coercive nature of labour law rights and the protective nature of labour law.
