Abstract:Avtor obravnava primerjalnopravne vidike (nacionalnih ureditev Nemčije, Španije in Francije) pravice samozaposlenih do kolektivnega dogovarjanja. Avtor ugotavlja, da so sistemi, ki urejajo uresničevanje pravice samozaposlenih do kolektivnega dogovarjanja med državami različni. Ni torej nujno, da bodo samozaposleni svojo pravico do kolektivnega dogovarjanja uresničevali po enakem pravnem sistemu (oziroma v identični pravno konceptualni obliki) kot delavci v delovnem razmerju. Na področju oblikovanja sistema kolektivnega dogovarjanja samozaposlenih so torej ključne odločitve nacionalnega zakonodajalca.

Title:Comparative analysis of the right of self-employed persons to collective bargaining
Abstract:The author examines comparative legal aspects (from Germany, Spain, and France) of the right of self-employed persons to collective bargaining. The author concludes that the systems governing the exercise of the right of self-employed persons to collective bargaining vary between the legal orders. It is therefore not necessarily the case that self-employed persons will exercise their right to collective bargaining under the same legal regime (meaning, in an identical legal-conceptual form) as employees in an employment relationship. The decisions of national legislators are therefore crucial in the development of a collective bargaining system for self-employed persons.
