Abstract:Prispevek podaja prikaz ustavnosodne presoje, iz katere izhajajo stališča Ustavnega sodišča v zvezi s tem, kaj je predmet varstva po 49. in 66. členu Ustave. Pri tem je še poseben poudarek namenjen novejšim odločitvam Ustavnega sodišča s tega področja. Sprejeta stališča se poskuša sistematizirati po zaokroženih vsebinskih sklopih in tako prispevati k jasnosti tega pregleda.

Title:The scope of protection under Articles 49 and 66 of the Constitution with an emphasis on recent Constitutional Court jurisprudence
Abstract:The article provides an overview of constitutional case law that reflects the positions of the Constitutional Court regarding the scope of protection under Articles 49 and 66 of the Constitution. Special emphasis is placed on the Court’s more recent decisions in this area. The adopted positions are systematically organized into coherent thematic sections in order to contribute to a clearer understanding of the overview.
